BLM Oil and Gas Lease Sales

The Bureau of Land Management is due to receive comments on an environmental review analyzing 51 parcels of land for the proposed June 2023 competitive oil and gas lease sale. The BLM Montana-Dakotas State Office released the assessment consistent with the direction in the 2022 Inflation Reduction Act. The proposed lease sale spans across five counties in North Dakota, totaling approximately 20,722 acres, and includes updated fiscal provisions authorized by the act.

BOEM Gulf of Mexico Renewable Energy Task Force

The Bureau of Ocean Energy Management will hold a meeting of the Gulf of Mexico Intergovernmental Renewable Energy Task Force chartered to facilitate coordination and consultation regarding potential renewable energy activities on the outer continental shelf. The discussion will focus on the planning process for offshore wind energy leasing in federal waters of the Gulf of Mexico. The task force will also discuss the recently announced first offshore wind lease sale in the area, which includes a 102,480 acres offshore Lake Charles Louisiana, and two areas offshore Galveston, Texas, one comprising 102,480 acres and the other 96,786 acres, with the potential to power almost 1.3 million homes.

BLM 200 MW Dry Lake East Energy Center Solar Project

The Bureau of Land Management will hold a virtual forum to discuss EAGL LLC’s proposal to construct and operate the Eagle Eye Solar Project, a 400-megawatt facility. The company has applied for a right-of-way grant to provide land and access for the project proposed on a solar variance area of about 2,600 acres. The project would support the current administration’s goal of a carbon-free power sector by 2035, as well as the direction in the Energy Act of 2020 to permit 25 gigawatts of solar, wind, and geothermal energy production on public lands by 2025.

BLM Wabuska Geothermal Exploration Project

The Bureau of Land Management is due to receive public input to prepare an environmental assessment for Open Mountain Energy LLC’s proposed geothermal exploration project in Lyon County, Nevada. As part of the exploration project, the agency is analyzing the impacts of up to 11 exploration wells, with a total proposed surface disturbance of up to 54.16 acres. Geothermal was the first renewable resource approved for production on public lands, with the first project approved in 1978.

NY PSC NY-Sun Program Review

The New York Public Service Commission is due to receive comments on the mid-program review of the NY-Sun initiative, which was expanded last year by adopting a target of 10 gigawatts of distributed solar by 2030. Regulators have authorized an additional budget of $1.474 billion to fully fund the expanded program. The review, filed in January, provides details on the status of, and activity in, the program, and updated project cost estimates based on developer-reported data, utility-reported interconnection costs, international cost trends, and other market or policy factors impacting costs. Among other things, the review considers project configurations and cost analysis, as well as an assessment of the potential impact of the 2022 Inflation Reduction Act. READ MORE

TN PUC Utility Cybersecurity Reporting Rules

The Tennessee Public Utility Commission is due to receive comments on proposed rules for utility cybersecurity reporting. Legislation enacted in 2021 requires regulated electric, water, wastewater and natural gas utilities to develop, implement, and maintain cybersecurity plans. From this year, utilities are required to provide documentation to the commission by July 1 of each year, showing that they are operating under a compliant cybersecurity plan. Further, the law requires the commission to enforce the statutory provisions and authorizes the promulgation of rules. The commission made revisions to the proposed rule based on public input from a rulemaking hearing held in March, and now seeks additional feedback and comments before final consideration for approval. 2300001

AR PSC Net Metering Rules

The Arkansas Public Service Commission is due to receive supplemental simultaneous comments for additional proceedings to address actions taken by the General Assembly that affect net metering rules adopted in December 2022. The rules address uncertainties associated with the expiration of mandatory grandfathering of the 1:1 net metering rate credit structure at the end of 2022. The commission has granted petitions for rehearing of the December order since the Arkansas General Assembly is in session and considering multiple bills which could impact commission rulings on the various petitions. The Arkansas Renewable Energy Development Act, as amended in 2019, directed the commission to allow net-metering facilities that have submitted a standard interconnection agreement to the electric utility after the effective date of the act but before Dec. 31, 2022, to remain under the rate structure in effect when the net-metering contract was signed, for a period of 20 years. HI PUC Distributed Resource Policy

The Hawaii Public Utilities Commission will host a technical conference to discuss modeling results in Phase 3 of its distributed energy resources program structure. The third phase, among other things, requires the Hawaiian Electric Companies to conduct additional modeling to develop accurate and informed export rates for the Smart DER Tariff and incentives for the Bring-Your-Own-Device tariff. The commission is evaluating its distributed generation proceeding in three tracks namely, DER program, advanced rate design, and technical issues. CO PUC Amendments to Net Metering Rules

The Colorado Public Utilities Commission will hold a public comment hearing on a rulemaking proceeding to implement net metering for individually metered multi-unit properties. Last year, the commission adopted a rule to enable owners and tenants of multi-unit buildings to share in the production from a net metered distributed generation installation pursuant to 2021 legislation that enacted measures to increase renewable energy deployment. Subsequently, industry groups recommended that the commission initiate a targeted rulemaking for individually metered properties. Rulemaking participants generally supported the recommendation, and subsequently, the commission opened a follow-on rulemaking to consider further revisions. 23R-0024E
