New York Governor Announces Creation of Special Counsel for Ratepayer Protection

The New York Public Service Commission has flagged four energy service companies (ESCOs) over their failure to submit annual compliance filings under Unifrom Business Practices, according to June 14 notices.

  • Bluesource Energy LLC failed to submit the yearly statement (January 31 Statement) that the information and attachments contained in the ESCO’s Retail Access Application Form and application package are current or if revisions are necessary. In May 2013 the company was deemed eligible to serve non-residential natural gas and electric customers in New York State, but regulators have since determined that the company does not currently have any customers in the state.
  • Got Gas? LLC failed to submit the same yearly statement (January 31 Statement) and must now show cause why its eligibility to act as an energy services company should not be revoked. The company was made eligible o serve residential and non-residential natural gas and electric customers in New York state in July 2014.
  • Amerigreen Energy LLC failed to submit the January 31 Statement and the regulator has since discovered that the company had filed for Chapter 7 bankruptcy protection. It started serving residential and non-residential electric and gas customers in New York state in April 2013.
  • Clear Choice Energy LLC failed to submit the same annual compliance filling as part of its Retail Access ApplicationForm. The company has had no customers since August 2018 and recently filed for Chapter 11 Bankruptcy.
